Energy Saving Requirements for Landlords in East Anglia

Private Rented Minimum Energy Efficiency Standards (MEES)

Don't Wait to Insulate



 

Business, Energy and Industrial Strategy (BEIS) has announced this week, 5th November 2018, that the plan to change the regulations pushing private sector landlords to install energy efficiency measures and will come into effect from 2019.

Since earlier this year landlords who own some of the coldest homes, i.e. those with an F or G EPC rating have been required to improve these homes but only where there was no cost to them. Following consultation landlords could be required to pay up to £3500 to improve these homes.

When the amendment was announced Energy and Clean Growth Minister Claire Perry said:

"While the vast majority of landlords take great pride in the properties they own, a minority still rent out housing that is difficult to keep warm. Upgrading these homes so they are more energy efficient is one of the most effective ways to tackle fuel poverty and help bring down bills for their tenants, saving them £180 a year. Everyone should be protected against the cold in their own home and today’s announcement will bring this reality closer.”

From the 1st April 2018 there has been a requirement for any properties rented out in the private rented sector to have a minimum energy performance rating of E or above on an Energy Performance Certificate (EPC). The regulations apply to new lets and renewals of tenancies from 1st April 2018, AND for all existing tenancies on 1st April 2020. It will be unlawful to rent a property which breaches the MEES requirement for a minimum E rating.

For most landlords this will mean that they will no longer be able to rent out a property with a rating of F or G after April 1st, 2018. Landlords should also be aware that under the Housing Act (2004), Local Authorities may respond to complaints from private tenants. The Local Authority must act where a Category 1 Hazard (including Excess Cold and/or Damp and Mould) exists and has discretionary powers to act where there is a Category 2 hazard in a privately rented property. Failure to bring the property up to a minimum energy rating of E may result in the Local Authority taking enforcement action.

We encourage Landlords to improve the energy efficiency of their properties, simple improvements such as increasing Loft Insulation or Cavity Wall Insulation may improve the energy efficiency of the properties enough to meet these new regulations.
